suna User Agreement

Welcome to use the suna AI video products and related services! Thank you for using our products and/or services (hereinafter referred to as "Services"). By using our Services, you (or hereinafter referred to as "User") agree to this Service Agreement. Please read the contents of this Service Agreement carefully and fully understand and follow the relevant terms.

Important Notice:

This Agreement applies to all suna products/services, including any upgrades and updates to the services and products you use during the term of this Agreement. If, during the reading of this Agreement, you disagree with any terms, please immediately cease using our Services. We may revise this Agreement due to changes in relevant laws and regulations, company business conditions, business strategy adjustments, and product service upgrades. The updated terms of the Agreement will be effective immediately upon publication, replacing the previous terms. You can review the latest version of the Agreement at any time while using our product services. If you disagree with the changes to the Agreement, please immediately stop using our product services. Continuing to use our product services will be deemed as acceptance of the changes to this Agreement.

If you are under 18 years old, we recommend that you have your guardian read this Agreement carefully and use our products and/or services or provide us with information only with your guardian's consent.

I. Service Content and Form

1.1 Service Content

suna is an "AI Video Creation" product based on various self-developed and open-source deep learning algorithms and image algorithms. It aims to provide text-to-video and image-to-video generation functions, dedicated to offering inspiration for visual content creation and assisting in artistic creation.

1.2 Service Form

To use this service, you need to download the app "suna" from the official app stores on iOS and Android. We grant you a personal, non-transferable, and non-exclusive license. You may only use these products and services for the purpose of accessing or using the Services.

1.3 Scope of AI Video Service License

You can use the videos created with our AI services for any purpose that complies with the laws of your country or region, including both commercial and non-commercial purposes, globally and in all regions, provided that you adhere to the laws of the location of use.

Provided that you do not violate the laws and regulations of your country or region, the copyright and usage rights of the works created through our services belong to you. We do not claim rights to these works and cannot provide copyright certificates or authorization agreements. You are also responsible for the content of your creations. For example, you may not use AI technology to illegally copy others' works, infringe on others' copyrights, or violate human rights or other legal aspects.

II. User Behavior Norms and Precautions

2.1 Product/Service Usage Norms

(1) You ensure that you will not and are prohibited from directly or indirectly: ① Deleting, hiding, or altering any patent, copyright, trademark, or other ownership statements displayed on or contained within suna products/services; ② Interfering with or attempting to interfere with the normal operation of suna products/services or any part or function thereof; ③ Bypassing, attempting to bypass, or claiming to be able to bypass any content protection mechanisms or data measurement tools of suna products/services;

(2) Without the company's written permission, no user or third party may directly or indirectly steal videos, images, or other content from suna products and related services in any way (including but not limited to hotlinking, redundant theft, illegal scraping, simulated downloads, deep linking, counterfeit registration, etc.), or remove or alter the rights management electronic information of the relevant content (including but not limited to hiding or modifying domain names, platform-specific identifiers, usernames, etc.).

(3) After obtaining the company's written permission, users and third parties must also adhere to the following norms when sharing or forwarding information content from suna products and related services: ① No modifications of any kind to the source web pages of suna products and related services, including but not limited to homepage links, ad system links, etc., and no obstruction, insertion, or pop-ups on the display of the source pages; ② Take secure, effective, and rigorous measures to prevent unauthorized third parties from illegally obtaining information content through any form, including but not limited to "spider" programs; ③ Do not use the related data content for purposes beyond the scope of the company's written permission, or disclose, provide, or allow third parties to use the content in any way.

If the user violates these guarantees and causes loss to suna products, services, users, or any partners, the user will be solely responsible for all legal liabilities and damages.

(4) You must not use this network service system for any illegal purposes; you must not use suna products and services to conduct any activities that may negatively affect the normal operation of the internet or mobile networks;

(5) You must not engage in the following activities using the services of suna products/services: ① Unauthorized access to computer information networks or use of computer information network resources; ② Unauthorized deletion, modification, or addition to the functions of computer information networks; ③ Unauthorized deletion, modification, or addition to the data and applications stored, processed, or transmitted in computer information networks; ④ Deliberately creating or spreading computer viruses or other destructive programs; ⑤ Any other activities that endanger computer information network security.

2.2 Content Norms and Policies

(1) The information content referred to in this Agreement means any content you create, copy, publish, or disseminate during your use of this service, also referred to as suna product/platform content.

(2) You understand and agree that suna is committed to providing users with a civilized, healthy, and orderly online environment. You must not use suna's platform services to create, copy, publish, or disseminate content that disrupts the normal operation of suna's platform, violates laws and regulations, or infringes on the legal rights of other users or third parties. You must not use suna's services for any illegal purposes.

(3) You understand and agree that your actions on this platform must comply with relevant laws and regulations and suna's platform policies, and must not engage in any illegal or improper activities, including but not limited to:

· Violating the laws, regulations, rules, and any legally effective norms of the location of use;

· Endangering national security, disclosing state secrets, subverting national power, or destroying national unity; harming national honor and interests;

· Inciting ethnic hatred, ethnic discrimination, or undermining national unity;

· Undermining national religious policies, promoting cults, or feudal superstitions;

· Spreading rumors, disrupting social order, or undermining social stability;

· Disseminating obscene, pornographic, gambling, violent, murderous, terroristic, or criminally inciting content;

· Insulting or defaming others, infringing on others' legitimate rights;

· Exploiting or attempting to exploit or harm minors in any way;

· Generating or disseminating verifiable false information and/or content intended to harm others;

· Generating or disseminating personal identification information that can be used to harm individuals;

· Any content based on online or offline social behaviors or known or predicted personal or personality traits aimed at or having the effect of discriminating against or harming individuals or groups;

· Content containing terror, violence, bloodshed, high-risk activities, or harming oneself or others' physical or mental health, including but not limited to any violence or (and) suicide, self-harm, self-injury, any threats to life and health, dangerous equipment like controlled items, and activities that incite or induce others to participate in dangerous or illegal activities that may cause personal injury or death;

· Any illegal or prohibited items, including but not limited to: drugs, prohibited substances, illegal tools, such as marijuana, opium, counterfeit money, firearms, tobacco, explosives, VPN software, hacking programs, etc.;

· Exploiting any weaknesses of specific groups based on age, social, physiological, or psychological characteristics to cause or potentially cause serious distortion in the behavior of that group or physical or psychological harm to others;

· Any content aimed at or having the effect of discriminating against individuals or groups based on legally protected characteristics or categories;

· Providing medical advice and medical result interpretation;

· Generating or disseminating information used in judicial, law enforcement, immigration, or asylum procedures, such as predicting personal fraud/criminal commitments (e.g., through text analysis, drawing causal relationships between assertions in documents, indiscriminate and arbitrary targeting).

(4) If you use suna products/services to upload, create, transmit, or otherwise disseminate content that infringes third parties' legal rights (including but not limited to patent rights, trademark rights, copyright and related rights, portrait rights, privacy rights, reputation rights, etc.), and this results in any complaints, reports, inquiries, claims, or lawsuits against this product, or any loss of reputation, assets, or property to this product, you should actively take all possible measures to ensure that this product is protected from such claims or lawsuits. You are fully responsible for all direct and indirect economic losses suffered by this product as a result.

(5) You must not use new technologies and applications, such as deep learning and virtual reality, to create, publish, or disseminate false information. When publishing or disseminating non-real information created using deep learning, virtual reality, or other new technologies and applications, you should prominently indicate that the information is not real.

(6) To promote the healthy development of internet content, all your activities on the suna platform must comply with the legal bottom lines, socialist system bottom lines, national interest bottom lines, citizens' legal rights bottom lines, social public order bottom lines, moral standards bottom lines, and information authenticity bottom lines. You must be responsible for all activities under your registered account, including any content you publish and any consequences arising therefrom. You should independently judge the content in this service and bear all risks arising from using the content, including risks from relying on the legality, accuracy, completeness, or practicality of the content. This product is unable and will not be responsible for any losses or damages resulting from these risks.

2.3 User Precautions

(1) Any user who finds content on suna that infringes on others' legal rights or violates suna's user service agreement has the right to file a complaint through suna's customer service feedback system or by emailing the official email address.

(2) According to China's "Regulations on the Management of Deep Synthesis Internet Information Services," providing deep synthesis-related services requires real-name authentication of users. Therefore, users in mainland China must complete phone number real-name authentication before they can continue to use AI video and other AI functions.

(3) To provide a technology-for-good AI creation tool for users and ensure the healthy development of suna in accordance with laws and regulations on AI-generated services in mainland China, we will review the instruction texts and video results uploaded by users in mainland China. The review process involves an initial machine review by Alibaba Cloud's content review API, followed by manual review if necessary, based on machine review results and user reports. For videos and instructions involving subversive or pornographic content and the publication of pirated or harmful content, we will automatically intercept and issue warnings, with repeated violations subject to severe penalties. Penalties may include: deducting usage counts and issuing warnings, temporarily or permanently restricting use, and banning all account permissions. Any costs and consequences arising from not heeding warnings and repeated violations must be borne by you, and we will not compensate for such losses.

(4) You understand and agree that, in order to comply with the laws and regulations on AI-generated services in mainland China, we need to retain your usage logs even after deleting user privacy videos and generated results. These logs will be encrypted and stored for 90 days, and will be automatically deleted after 90 days. We will not access your logs except under the direction of relevant authorities or if you report a bug and need to query the issue. We will take necessary measures to protect the data security of these logs.

(5) You understand and agree that suna has the right to reasonably judge and penalize behaviors that violate relevant laws, regulations, or this Agreement, and to take appropriate legal actions against any users who violate laws or regulations. suna will also report relevant information to the authorities according to laws and regulations, and you should independently bear all legal responsibilities arising therefrom.

(6) You understand and agree that if you violate this Agreement or the terms of related services, leading to any claims, demands, or losses asserted by third parties, you shall bear the responsibility independently; you must also compensate for any losses suffered by this product as a result.

(7) You understand and agree that, to provide you with effective services, this product/service will use resources such as the processor and bandwidth of your terminal device. The use of this product/service may incur data traffic fees, which you need to check with your carrier and bear the relevant costs.

(8) When using this product/service, you must bear the following risks from suna that cannot be controlled, including but not limited to: ① Risks of personal information loss or leakage due to irresistible factors; ② You must choose the product/service version that matches your installed terminal device; otherwise, any issues or damages caused by mismatches between the product/service and terminal device model will be your responsibility; ③ Risks arising from accessing third-party websites while using this product/service, due to third-party websites and related content, will be your responsibility; ④ Risks and responsibilities arising from the dissemination of content you publish being forwarded or shared by others; ⑤ Risks such as failed logins, incomplete data synchronization, or slow page loading due to unstable wireless network signals or small wireless network bandwidth; ⑥ You acknowledge and are aware that all content generated during your use of the service is produced by AI models, and we make no guarantees regarding the accuracy, completeness, or functionality of the generated content, which does not represent our attitude or viewpoints.

(9) Third-Party Products and Services

When using products or services provided by third parties within this product/service, please comply with the third party's user agreement. This product will not be liable for any disputes that may arise between you and the third-party products or services.

When using this product/service or requesting specific services from suna, this product/service may invoke third-party systems or rely on third parties to support your use or access. The results of such use or access are provided by the third party (including but not limited to content accessed through personal centers, etc.). This product does not guarantee the security, accuracy, effectiveness, or other uncertainties of services and content provided by third parties. Any disputes or damages arising from such third-party services are unrelated to this product, and this product assumes no responsibility.

3. Service Fees and VIP Membership

3.1 Paid Service Description suna offers some services for free, but certain features require a VIP membership or energy packs. The specific rights, usage rules, billing methods, fee standards, and payment methods for VIP memberships or paid cards are subject to the platform's provided details and related page content. suna may modify and change the fee standards and methods for paid services as needed. suna will notify or announce these changes or new fees on the relevant service page before the changes take effect. If you disagree with these changes, you should stop using the service.

3.2 Service Activation, Rights Content, Service Term, and Fee Standards

1. To activate a paid service, you must ensure that you have full civil rights and civil capacity during the activation and use of this service, and that you have the actual ability to sign and perform the rights and obligations under this agreement.

2. You can complete the purchase of this service and become a VIP member or acquire consumable paid credits through various existing and future payment channels or methods designated by this app. Once you confirm and successfully pay the membership service fee and/or complete all payment purchase procedures as prompted on the service page and pass the app's review, you can enjoy this service.

3. VIP membership or paid credit rights may include some or all of the following types (the actual rights types and content may change, and the specific rights should be as displayed on the service activation page):

1. Enjoy exclusive member features and materials during the service period (specific content should be as displayed on the page);

2. Obtain additional video creation opportunities;

3. Other rights. To improve user experience and service content, this app may update and modify suna memberships, video energy packs, and/or related services, rights, functions, interfaces, etc., including developing new functions/rights and deleting old functions/rights. You may continue to use the corresponding rights, functions, or services according to the changed actual situation of this service and apply the relevant provisions of this agreement;

4. The service term of this service is based on the period corresponding to the membership fee you choose and pay. After the service term expires, this app will stop providing the service;

5. If you wish to enjoy the "subscription (continuous purchase) and automatic renewal services" related to this service, please carefully read the "suna Continuous Subscription Agreement" section and make your choice cautiously according to the service purchase page's prompts and operation instructions;

6. When you apply to activate this service, you need to pay the corresponding service fee as prompted on the page to complete the activation. Based on changes in rights, market, and business development, this app may adjust the service fee required for service activation. Service fee adjustments will take effect from the date of announcement. Services activated before the effective date will not be affected, but if you need to renew after the service expires, you must pay according to the adjusted fee standard;

7. As paid service member rights are for virtual content consumption, they cannot be transferred or refunded after payment is completed, unless otherwise stipulated by laws and regulations. If a fault occurs during the use of the application, resulting in the consumption of paid credits/limits without receiving the corresponding service, this app will only refund the amount related to the fault; other amounts that have been used normally or have not yet been used will not be refunded.

4. Intellectual Property and Related Rights

4.1 suna reserves all ownership, intellectual property rights, and/or other legal rights to the following content and information:

1. suna products/services and all their elements, including but not limited to all content, data, technology, software, code, user interface, trademarks, logos, and any derivative works related to them;

2. Any information and feedback provided by users related to the suna products/services.

3. Without the explicit consent of this product or agreement otherwise, the above materials may not be directly or indirectly published, broadcasted, rewritten, reissued for the purpose of broadcasting or publishing, or used for any commercial purpose on any media. This product is not legally or financially responsible for any damages arising from delays, inaccuracies, errors, or omissions in the transmission or delivery of all or part of the above materials.

4. All rights to any software (including but not limited to any images, photos, animations, videos, recordings, music, text, additional programs, and accompanying help materials contained within the software) used by suna products/services to provide network services belong to the copyright holder of the software. Users may not reverse engineer, decompile, or disassemble the software or discover its original code in any other way, or engage in any copyright infringement activities without permission from the copyright holder.

4.2 User-Created Content The intellectual property rights to content (video works) created by users while using this service belong to the users (creators). suna only provides creation tools and does not claim any copyright. However, by using this product, users implicitly allow the suna platform to use and disseminate their created works on this product and related promotional materials. suna's related actions are not considered infringement. At the same time, users must ensure that their created content complies with the relevant usage regulations mentioned above and adheres to laws and regulations.

5. Disclaimer

5.1 Due to the nature of network services, users agree that suna products/services may change, interrupt, or terminate part or all of the network services at any time. If the changed, interrupted, or terminated network services are free network services, suna is not required to notify users or assume any responsibility to any user or third party.

5.2 You understand that suna products/services may need to periodically or intermittently maintain or repair the platform or related equipment providing network services. If such situations cause interruptions in paid network services within a reasonable time, suna will not be liable, but will provide notice as much as possible in advance.

5.3 suna products/services may change this service or remove some of its functions at any time for any reason. suna products/services may cancel or terminate services to users at any time. The decision to cancel or terminate services does not require a reason or notice to users. Once the service is canceled, the user's right to use this service immediately terminates. Once the service is canceled or terminated, any information stored in this service may not be recoverable.

5.4 suna products/services do not guarantee (including but not limited to):

1. The service meets the user's requirements;

2. The service will be uninterrupted, timely, secure, reliable, or error-free, and any products, services, or other materials obtained through the service meet the user's expectations;

3. You use any information obtained through the service at your own risk; you are fully responsible for any damage to your computer system or data loss resulting from such use.

4. suna does not bear any direct or indirect compensation for:

1. Profit, business reputation, data loss, or other tangible or intangible losses caused by the use or inability to use this service;

2. Disputes or losses arising from authorizing third parties (including third-party applications) to access/use their services.

5.7 suna will provide corresponding services based on the service type you choose. You understand and agree that, based on user experience or suna platform operation safety, platform rules requirements, and healthy development factors, suna has the right to choose service providers or partners, decide on the opening of functions, data interfaces, and the scope of data disclosure, and may suspend or terminate the provision of services to users who have:

1. Violated laws or regulations or this agreement;

2. Affected user experience;

3. Security risks;

4. Violated suna platform operation principles or other management requirements of this product.

6. Third-Party Software or Technology

6.1 This product/service may use third-party software or technology (including open-source code and public domain code, etc.) that has been legally authorized.

6.2 If this product/service uses third-party software or technology, this product will display relevant agreements or other documents in accordance with relevant regulations or agreements, which may be presented through this agreement’s annexes, specific folders in the software installation package, or open-source software pages. These agreements, documents, and webpages are integral parts of this agreement and have the same legal effect. You must comply with these requirements. Failure to do so may result in lawsuits, fines, or other sanctions from the third party or government authorities, and this product may be required to provide assistance. You will bear legal responsibility yourself.

6.3 Any disputes arising from the use of third-party software or technology in this product/service should be resolved by the third party. This product does not provide customer support for third-party software or technology. If you need support, please contact the third party.

7. Others

7.1 To the extent permitted by law, suna reserves the final interpretation rights of this agreement.

7.2 This agreement takes effect once published. This product has the right to modify the agreement content at any time. If you disagree with the modifications to the agreement terms, you have the right to stop using the network services. If you continue to use the network services, it is considered that you accept the modifications made by this product to the agreement terms. If you do not accept the modified agreement, you should stop using the software.

7.3 The headings of each clause in this agreement are for the purpose of helping you understand the main points of the clauses and do not affect or limit the meaning or interpretation of the agreement clauses. To protect your own rights, it is recommended that you carefully read the specific wording of each clause.
